Why do we need to protect IP assets

1)To protect our IP resources we need to attain legal Ownership.

2) Marketability (Technology readyness level/Commercial readyness level/Societal readyness)To ensure an invention is marketable i.e. buy/selling ready, we Patent it.


How to protect IP Assets

Patent

A government-issued property right that gives the holder exclusive rights to an invention for a set period of time(20 years in India). 

 Patents protect the design and functionality of an invention. They can be for processes, machines, compositions of matter, or manufactures. Patents are limited in time, content, and geography. 

Trademark

A word, symbol, design, or phrase that identifies a product and differentiates it from similar products. Trademarks protect a brand. 

In India trademark is  issued for 10 years after grant of trademark.

Copyright

Protects original works of authorship, such as writings, art, architecture, and music. Copyrights give the creator or owner the exclusive right to make a copy of their work. 

Trade secret

A form of IP that protects confidential business knowledge that gives an organization a competitive edge. 

Trade secrets must be: Not known in the general public ,Provide some economic benefit to the holder ,Kept secret through reasonable effort, such as non-compete agreements or non-disclosure agreements (NDAs)

In India Trade secrets is valid infinitely till it's kept secret by owner.


Coca-Cola

The Coca-Cola brand is a trademark, the formula is a trade secret, the artwork on the bottle is protected by copyright, and the shape of the bottle is protected by a design patent and trademark.


Example  inventions for Global problems

1)Taraltech Maji

It's a reactor device from Taraltec Solutions, applies a breakthrough technology to disinfect water by destroying the microbes in it.


2)Jaipur foot


 The Jaipur Foot is protected by intellectual property. 


The Jaipur Foot is a low-cost prosthetic limb that was developed in 1968 by R.C. Sharma and Dr. P.K. Sethi at Bhagwan Mahavir Viklang Sahayata Samiti in Jaipur.
